1. About Rootime

Rootime ("we", "us", "our") provides an AI-powered SMS reception service for Australian tradespeople. By signing up or using our service, you agree to these Terms of Service.

These terms apply to all users of the Rootime platform, including business owners (tradies) and their customers.

2. The Service

Rootime provides:

  • An AI assistant (Roo) that responds to missed calls via SMS on your behalf
  • Automated lead capture and customer information collection
  • SMS notifications to you when a new lead is captured
  • An online dashboard to view and manage your leads

We set up and configure the service for you. You are responsible for ensuring the information you provide about your business is accurate.

3. Subscriptions & Billing

  • First month offer: Your first month is charged at 50% of the standard monthly rate as a promotional offer.
  • Ongoing billing: After the first month, your subscription renews monthly at the full rate for your plan.
  • Cancellation: You may cancel at any time. Your service will continue until the end of the current billing period. We do not offer refunds for partial months.
  • Price changes: We will give you at least 30 days notice of any price increases.
  • Phone number costs: A dedicated phone number is included in your setup. If you cancel and wish to keep the number, additional porting fees may apply.

4. Acceptable Use

You must not use Rootime to:

  • Send spam, unsolicited messages, or engage in misleading conduct
  • Impersonate another business or person
  • Violate any applicable Australian law, including the Spam Act 2003
  • Use the service for any purpose other than legitimate business communication

5. AI Responses & Accuracy

Our AI assistant is designed to be helpful and professional, but:

  • AI responses may not always be perfect. You are responsible for following up with your customers.
  • We do not guarantee that all leads will be captured accurately.
  • You should not rely on the AI to provide specific legal, safety, or technical advice to customers.
  • Emergency situations (gas leaks, flooding, etc.) are directed to call 000 first — this is a safety measure, not a guarantee.

6. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

  • Rootime is not liable for any missed leads, lost business, or indirect damages arising from use of the service.
  • Our total liability to you in any month is capped at the amount you paid us in that month.
  • We are not responsible for Twilio, Anthropic, or Google outages that affect service availability.

Nothing in these terms limits your rights under the Australian Consumer Law where they cannot be excluded.

7. Termination

We may suspend or terminate your account if you:

  • Breach these terms
  • Fail to pay your subscription
  • Use the service for illegal or harmful purposes

You may terminate your account at any time by contacting us.

8. Changes to These Terms

We may update these terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Continued use of the service after that date constitutes acceptance of the new terms.

9. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
